There’s no law against this kind of stuff. So yes, it is legal.
In general anybody can work on any kind of car. It may not be a good idea, but BMW has no special protection under the law. In fact many car manufacturers try to hide their special diagnostic code so independent repair shops CANNOT work on their cars. But their efforts have been defeated and the US courts have mandated that all manufacturers publish their diagnostic codes so ANY independent shop can work on ANY car (if they feel competent).

It shouldnt be illegal. However if he is reflashing it with a performance chip that will make more power, then it is illegal if your state has such laws. I also have VAG-COM to check and clear codes on my VW GTI and my sister’s audi.
